Same Job Same Pay is not an automatic process – the MEU is required to apply site-by-site. The union must prove to the Commission that labour hire workers are performing the same work for less pay than direct employees. If this is found to be the case, the Fair Work Commission must then issue an order requiring labour hire workers to be paid the same rate as directly employed workers doing the same job.

Please note: Pay rises due to orders from the Fair Work Commission will come into effect on 1 November 2024. If the order has not been issued by that date, the pay rise will be in effect from the date the order is made.
