Same Job Same Pay is not an automatic process – the MEU is required to apply site-by-site. The union must prove to the Commission that labour hire workers are performing the same work for less pay than direct employees. If this is found to be the case, the Fair Work Commission must then issue an order requiring labour hire workers to be paid the same rate as directly employed workers doing the same job.
Please note: While the Fair Work Commission is able to issue Same Job Same Pay orders, they will not come into effect before 1 November 2024.
