The plea deal struck with Mastermyne over the 2022 death of Gavin Feltwell is unacceptable and sends the message that mining companies who kill workers can get away with just a slap on the wrist.
Mining and Energy Union Queensland District President Mitch Hughes said today’s decision would fail to convince miners that the industry prioritises worker safety over company profits.
“This is a shockingly weak outcome against a company with a proven history of endangering, and killing, coal mine workers.
“It is outrageous that a multi-million-dollar company can kill a worker, plead guilty, and get away with only paying a fine – a fine which will more than likely be covered by their insurance anyway.”
MEU General Vice President Stephen Smyth, who was District President at the time and oversaw the ISHR’s investigation into the fatality in his previous role, was dismayed by the result.
“Gavin Feltwell was a much-loved member of our Union and of the Bowen Basin mining community. We felt the injustice of his death, and we feel the injustice of his killers getting away scot-free.
“Gavin’s life was worth far, far more than $300,000. I am disgusted that Mastermyne – who have admitted their culpability – are walking away without a recorded conviction.”
